Terms and Conditions of Use for “Hola Asia”

Welcome to Hola Asia, the employment platform dedicated to connecting employers with candidates in the Asian labor market. By registering and using our platform, you agree to the following Terms and Conditions. If you do not agree with these terms, you must not use our services.

1. General Information

“Hola Asia” is an employment platform that allows employers to post positions and candidates to apply for available job openings. Access to and use of our platform is subject to these Terms and Conditions and our Privacy Policy, which governs how we treat your personal data.

2. Registration and Account Creation

To access the “Hola Asia” services, both employers and candidates must register and create an account. In doing so, users agree to:

Provide accurate and up-to-date information when completing the registration form.
Maintain the confidentiality of their account, including username and password, and not share it with third parties.
Immediately notify us of any unauthorized use of their account.

Candidates: To apply for job openings, you must upload your resume (CV) and other relevant documents, and provide additional information as requested by the employer.

Employers: To post vacancies, you must provide accurate details about the job opening, requirements, and working conditions.

3. Use of the Platform

By using “Hola Asia,” users agree to:

Use the platform only for lawful purposes, and not for fraudulent, deceptive, or illegal activities.

Respect applicable local and international laws, including those related to the protection of personal data and non-discrimination in employment.
Not publish content that is offensive, discriminatory, defamatory, or infringes the intellectual property rights of third parties.
Not interfere with or manipulate the operation of the platform in any way that may affect its integrity or accessibility for other users.

4. Intellectual Property

All content, design, logos, trademarks, software, and other materials related to the “Hola Asia” platform are the property of Hola Asia or its licensors and are protected by intellectual property laws. Users are not entitled to copy, reproduce, distribute, or modify any content on the platform without the express authorization of Hola Asia.

5. Privacy and Protection of Personal Data

“Hola Asia” is committed to protecting user privacy and complying with Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP).

By registering, users agree that their personal data will be collected and used to offer employment services, communicate with users, and improve the platform. For more details, please see our Privacy Policy.

Users have the right to access, correct, delete, and object to the use of their personal data as required by law.

6. Platform Responsibilities

“Hola Asia” acts as a facilitator between employers and candidates, but does not guarantee job openings or that candidates will be selected by employers.

For Employers: “Hola Asia” is not responsible for the accuracy or quality of the applications received or the results of the hiring process.
For Candidates: “Hola Asia” does not guarantee employment, as the final selection rests exclusively with the employers.

“Hola Asia” is not responsible for any disputes, disagreements, or breaches between employers and candidates.

7. Fees and Payments

Access to the platform is free for candidates. However, employers must pay fees to post job openings or opt for premium services that improve the visibility of their ads.

Openpay is used as the payment gateway.

Payment will be processed exclusively through the payment methods available on the platform. Employers must ensure that the billing information provided is correct and up-to-date.

8. Security

“Hola Asia” implements reasonable security measures to protect users’ personal data. However, we cannot guarantee that data transmissions over the Internet are completely secure. Users are responsible for maintaining the confidentiality of their account information and notifying “Hola Asia” of any unauthorized use.

9. Marketing and Email Communications

By registering and using “Hola Asia,” both employers and candidates agree that we may send them electronic communications related to the platform, such as updates, job postings, newsletters, promotions, and other content.

10. Account Modification and Cancellation

Users may modify or cancel their account at any time. “Hola Asia” reserves the right to suspend or cancel an account if inappropriate use or violation of these Terms and Conditions is detected.

In the event of cancellation, users will lose access to all platform services.

11. Modification of the Terms and Conditions

“Hola Asia” reserves the right to modify these Terms and Conditions at any time. Modifications will become effective upon publication on the platform. Users are advised to periodically review these terms.

12. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the United Mexican States. In the event of a dispute, both parties submit to the jurisdiction of the competent courts in the state of Jalisco.

13. Acceptance of the Terms and Conditions

By registering and using “Hola Asia,” users expressly accept these Terms and Conditions. If you do not agree with any of the provisions set forth herein, do not use the platform.
